Kids City Hawaii Participant Agreement

Assumption of Inherent Risks, Acknowledgment of Rules, and Release

Important Notice: Please read carefully. This agreement affects legal rights. By signing electronically, I confirm that I understand and voluntarily agree to all terms below for myself and for each minor participant listed in my Roller registration.

1. Signer’s Authority: I am at least eighteen years old and am signing for myself and, where applicable, as the parent or court-appointed legal guardian of each listed minor participant (“Participant”). I represent that I have legal authority to sign for every listed minor and will not sign for a child for whom I lack that authority.

2. Activities, Unpredictable Child Behavior, and Inherent Risks: Kids City is an active indoor recreation facility. Activities may include climbing structures, slides, trampolines or bouncing surfaces, obstacle and challenge elements, ball pits, soft-play equipment, tunnels, nets, stairs, ramps, interactive games, ride-on equipment, parties, classes, and movement among children and adults of different ages, sizes, abilities, and experience.
   I understand that these activities involve inherent risks that may remain even when reasonable care is used. A Participant may fall or collide in a ball pit or soft-play area; strike the head, face, eye, or body against another person, floor, wall, platform, padding, play structure, equipment, or an unexpected surface; or have fingers, hands, toes, feet, hair, clothing, jewelry, eyeglasses, or personal items pinched, caught, trapped, crushed, cut, or entangled in equipment or between moving or stationary surfaces. Eyeglasses, hearing devices, jewelry, or other personal items may break and cause additional injury.
   I understand that children may act suddenly, impulsively, and unpredictably. A child may climb, reach, crawl, jump, pull, push, enter a closed, restricted, or unintended area, or place a hand, finger, foot, or other body part into an opening or between surfaces, despite posted rules, warnings, adult supervision, or staff instructions. Such conduct may occur within seconds and without enough warning for a supervising adult or staff member to intervene.
   Possible consequences include cuts, scrapes, bruises, puncture wounds, bleeding, pinch or crush injuries, nail injuries, sprains, strains, dental injuries, broken eyewear, eye or facial injuries, fractures, dislocations, concussion, head or spinal injury, partial or complete loss of a fingertip, finger, or toe, permanent scarring, disfigurement, emotional distress, illness, disability, paralysis, and, in rare cases, death. I understand that no list can describe every inherent risk or every way an injury or loss may occur. I acknowledge and assume the inherent risks arising from unpredictable child behavior and unintended or prohibited use of the facility or equipment, to the fullest extent permitted by Hawaii law.

3. Health, Ability, and Safety Instructions: I confirm that each Participant is reasonably able to participate, subject to any limitation I disclose to Kids City. I will promptly inform staff of any allergy, disability, medical condition, medication need, behavioral concern, sensory need, wandering or elopement tendency, or other condition that may affect safe participation or emergency response.
   I acknowledge that rules, warnings, equipment restrictions, and safety instructions are posted, displayed, provided electronically, or available from staff. I have had an opportunity to review them and ask questions. I will ensure compliance with all age, height, weight, capacity, clothing, grip-sock, food, and equipment restrictions and all staff instructions. Kids City may deny or stop participation when staff reasonably believe a safety concern exists.

4. Continuous Parent or Guardian Supervision: Except during a Kids City program expressly identified in writing as staffed or drop-off, I, or another responsible adult authorized by me, have the primary and continuous responsibility to actively supervise each minor child in my care throughout the entire visit. I must remain on the premises, know where each child is at all times, stay close enough to observe the child’s activities and intervene promptly, and provide closer or hands-on supervision when appropriate for the child’s age, ability, behavior, or needs.
   I understand that Kids City staff monitor facility operations and enforce general rules but are not individual babysitters, do not assume custody or one-to-one supervision merely because a child enters the facility, and cannot observe or prevent every sudden or unsafe act. I will not rely on Kids City employees to stop a child from climbing, reaching, entering a restricted or unintended area, or placing a hand, finger, foot, or other body part into an opening or between surfaces.
   I will not leave a child unattended, permit unsafe or aggressive conduct, allow entry into closed or age-inappropriate areas, or allow phone use, conversation, food, work, or another distraction to interfere with my supervision. I understand that a child may act suddenly and unpredictably and that an injury may occur within seconds when appropriate adult supervision is not maintained. I accept responsibility, to the fullest extent permitted by Hawaii law, for injury or loss arising from my failure, or the failure of an adult supervising my child, to provide appropriate supervision. Kids City may stop play or remove a person for unsafe, disruptive, abusive, threatening, or noncompliant conduct, subject to applicable law and posted policy.

5. Entry, Exit, Wandering, and Authorized Release: I understand that Kids City is not a secure childcare or detention facility. Children may move quickly, hide, separate from their group, approach an exit, or attempt to follow another guest. Except during a written staffed or drop-off program, I am responsible for knowing my child’s location at all times and for preventing my child from wandering, approaching an exit, following another guest, or leaving without me.
   I will follow all admission, wristband or identification, gate, re-entry, and check-out procedures. I will not allow an unrelated child to leave with me, bypass a controlled gate for another group, lend or alter identification, or request release contrary to recorded authorization. I will promptly notify staff if a child is missing, attempts to leave, is approached by a suspicious person, or if custody or pickup authority is disputed.
   Kids City may take reasonable, temporary safety measures while confirming identity, locating a supervising adult, contacting an authorized pickup person, or requesting help from security or law enforcement. These measures may include asking a child or adult to remain in a designated area, briefly delaying exit while identification is checked, or refusing release to a person not reasonably verified as authorized, to the extent permitted by law. I will provide accurate pickup and custody information and understand that staff cannot enforce an undisclosed custody order.

6. Assumption of Inherent Risks: I voluntarily choose to enter and participate. I knowingly assume for myself and, to the fullest extent permitted by Hawaii law, for each minor Participant, all inherent risks described above and all other inherent risks that a reasonable person would understand to be associated with the activities. I understand that injury or loss may occur even when reasonable care, maintenance, rules, instruction, and supervision are used.

7. Release and Agreement Not to Sue: In consideration of being allowed to enter or participate, I release and agree not to sue KIDS CITY LLC, doing business as Kids City, and its owners, members, managers, officers, directors, employees, agents, volunteers, affiliates, landlords, property managers, equipment providers, successors, and assigns (“Released Parties”) for claims by me arising from injury, illness, death, property loss, or other damage caused by the inherent risks of the activities, to the fullest extent permitted by Hawaii law.
   This release is not intended to release any claim that Hawaii law prohibits from being released, including a claim based on gross negligence, reckless or wanton misconduct, or intentional misconduct. If applicable law does not permit a parent to release a minor’s claim as broadly as stated, this agreement remains effective as to the signer’s own claims and every other lawfully releasable claim.

8. Communicable Illness and Personal Property: I will not bring a Participant who has a fever, vomiting, diarrhea, a contagious rash, or another symptom or diagnosis that reasonably presents a communicable risk. I understand that cleaning and hygiene measures cannot eliminate exposure in a public play environment. I am responsible for securing personal property, and, to the fullest extent permitted by law, Kids City is not responsible for ordinary loss, theft, or damage to unattended property.

9. Café, Food, Beverage, Allergy, and Choking Risks: I understand that purchasing or consuming food or beverages at Kids City is voluntary and may involve risks, including stomach discomfort, nausea, vomiting, diarrhea, foodborne illness, allergic reaction, accidental allergen cross-contact, choking, and burns from hot food or beverages. I understand that Kids City may prepare, handle, store, or serve products containing or exposed to major food allergens, including milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soy, and sesame, and that Kids City cannot guarantee an allergen-free environment. I am responsible for determining whether food or beverages are appropriate for each minor Participant in my care, reviewing available ingredient and allergen information, informing café staff of known allergies before ordering, supervising children while they eat or drink, cutting or modifying food when appropriate, and preventing children from consuming food belonging to another guest or food that has not been approved by the supervising adult. I accept responsibility for outside food or beverages that I or my guests bring into the facility. I acknowledge and assume the inherent risks associated with consuming food and beverages, including accidental allergen cross-contact and unpredictable individual reactions, to the fullest extent permitted by Hawaii law. Nothing in this section releases Kids City from liability that cannot lawfully be released.

10. Emergency Care: If I cannot be reached promptly, I authorize Kids City to provide or arrange reasonable first aid and contact emergency medical services for a Participant. I understand that Kids City personnel may not be licensed medical professionals and that emergency responders determine treatment and transportation. I accept responsibility for resulting charges to the extent imposed by law.

11. Hawaii Law, Severability, and Duration: Hawaii law governs this agreement. If a provision is held invalid or unenforceable, it shall be narrowed when permitted, and the remaining provisions shall continue in effect. This agreement applies to visits and activities occurring for twelve months after electronic signature unless Kids City requires a new agreement sooner because activities, rules, ownership, law, or risks materially change.

12. Electronic Acknowledgment: By signing electronically, I confirm that I have read and understand this entire agreement, had an opportunity to ask questions, received no promise inconsistent with it, and agree freely and voluntarily. I understand that I may decline to sign and not participate, and that this agreement affects legal rights, including the right to bring certain claims.
